Sydney North Planning Panel signs off on a 10-site amalgamation in St Leonards

Evergreen gets the green light from the Sydney North Planning Panel to build three residential flat buildings (ranging from 12 – 19-storeys), comprising a total of 232 dwellings and basement parking for 348 vehicles on land known as 1 – 5 Canberra Avenue, 4 – 8 Marshall Avenue and 2 – 8 Holdsworth Avenue in St Leonards. The site is an amalgamation of 10 properties.

The site is located within the St Leonards South Precinct, which was brought into effect on 1 November 2020 through amendments to the Lane Cove Local Environmental Plan 2009. Precinct planning was finalised concurrently with the St Leonards Crows Nest 2036 plan.

With a total site area of 6728 square metres and R4 zoning, the existing structures include detached and semi-detached dwelling houses on separate allotments with an assortment of ancillary structures.

The building heights will range from 43.5 metres – 64.8 metres with mapped FSR controls of 3.55:1 – 3.85:1. 56% of the units will be two-bedrooms with 28 affordable housing dwellings included.

Landscaping works will feature a natural walk, open lawns, picnic tables, kids cycle area, communal vegetable gardens. Other features include a lap pool, outdoor working spaces and rooftop terraces with views of the Sydney Harbour Bridge.

Required amalgamation pattern for the St Leonards South Precinct

With the development proposal excluding 2 Marshall Avenue, North Sydney Council asked Evergreen to address the planning principle relating to isolated sites. Evergreen submitted a clause 4.6 variation request to vary the minimum site area standard for Area 1 of the St Leonards South Precinct (3000 square metres).

Due to the exclusion of 2 Marshall Avenue, the development proposes a site area of 2736 square metres for Area 1, which is 264 square metres below the minimum lot size required by clause 7.2 of the Lane Cove LEP. This equates to an 8.8% variation to the development standard.

Council and the Panel accepted that Evergreen obtained independent evaluations and made reasonable attempts to purchase 2 Marshall Avenue prior to lodging the DA. Both were satisfied that development can still proceed despite an agreement not being reached between the two parties.
