Parramatta’s new Local Environmental Plan 2023: Here’s what you need to know

In May 2016, the new City of Parramatta LGA was created from parts of the former council areas of Auburn, Holroyd, Hornsby, Parramatta and The Hills.

As a result, different planning controls applied to different parts of the LGA, creating a lot of confusion for landowners and developers.

Council subsequently prepared what was known as the ‘Harmonisation Planning Proposal’, which contained draft planning controls to harmonise the existing five Local Environmental Plans.

On 2 March 2023, the NSW Department of Planning and Environment finalised this planning proposal – now formally known as ‘Parramatta Local Environmental Plan 2023’.

In finalising the new LEP, the Department made some key policy changes, including:

1.     Dual Occupancy Prohibition Areas

Council’s proposal to expand the dual occupancy prohibition area through the suburbs of Dundas, Dundas Valley, Oatlands and parts of Eastwood and Epping was not supported.

As a consequence, there are now 89 lots on the north side of Carlingford Road in Epping that have also been removed from the prohibition areas.

The Department retained the prohibition of subdivision of dual occupancies in the former Hills LGA.

2.    Floor Space Ratio and Building Height for R3 Medium Density Residential land

 

The Department did not support Council’s endorsed approach to introduce standard FSR of 0.6:1 and an 11 metre building height for all R3 zoned land across the LGA.

3. Downzone of land from R3 Medium Density to R2 Low Density

The Department only supported zoning changes from R3 to R2 land at Speers Road in North Rocks.

Due to concerns with reduced development potential in nominated areas and inconsistencies with Local Housing Strategy requirements for housing diversity, the Department did not support Council’s endorsed approach to change the zoning of R3 land, as proposed in Council’s version, for Campbell Street in Northmead, Lawndale Avenue in North Rocks and Felton Road in Carlingford.

4. Standardised minimum lot sizes for battle-axe lots

The Department did not support Council’s endorsed approach to standardise battle-axe minimum lot sizes to 670 sqm across the LGA consistent with the Parramatta LEP 2011.

The Department advised that there were concerns with reduced net loss in residential lots in the former Hornsby LGA and that there were no existing provisions for battle axe lots in other legacy LEPs.

As a consequence of this policy change, the standard minimum lot size applicable is subject to the minimum lot size map. However, if a lot is a battle-axe lot or other lot with an access handle, then the area of the access handle must be included in calculating the lot size.

Alongside the consolidated Parramatta LEP will be a consolidated Development Control Plan, which is set to be finalised later this year.
