Key changes to dual occupancy and semi-detached dwelling controls in Bayside LGA

A council-led planning proposal is seeking to make amendments to Bayside LEP to introduce minimum lot size and minimum lot width for dual occupancies and semi-detached dwellings in the R2 zone. 

The proposal is part of a suite of three draft planning proposals being prepared by Bayside Council to update and rationalise planning controls for residential uses in the R2 and R3 zones to align better with Council’s Local Housing Strategy. 

Prior to Bayside LEP 2021, dual occupancies were permitted under the former Rockdale LEP and prohibited in all residential zoned under the former Botany Bay LEP. No controls in the Bayside LEP govern lot sizes for new dual occupancies or semi-detached dwellings, except for the Rockdale DCP which requires a minimum lot size of 700 square metres and a 15-metre frontage for duplexes.  

Proposed controls will comprise two separate clauses introducing new minimum lot sizes, subdivision lot sizes and lot width controls across the R2 zone. A new special provisions map is proposed, which will delineate certain R2 zoned land as ‘Area A’ in the suburbs of Botany, Mascot, Rosebery and Eastlakes. 

Area A

Duplex development in Area A

Dual occupancy developments will be subject to the following controls: 

(a) minimum lot size of 550 square metres, and 

(b) minimum frontage of: 

  • 15 metres for a lot that adjoins a single road, or
  • 12 metres for a lot that adjoins more than one road or laneway. 

Semi-detached development in Area A 

Semi-detached developments not involving subdivision will be subject to the following controls: 

(a) minimum lot size of 275 square metres, and

(b) minimum frontage of: 

  • 7.5 metres for a lot that adjoins a single road, or 
  • 6 metres for a lot that adjoins more than one road or laneway. 

Duplex development on all other R2 zoned land 

All other proposed dual occupancies will be subject to the following controls: 

(a) minimum lot size of 650 square metres, 

(b) minimum frontage of: 

  • 15 metres for a lot that adjoins a single road, or
  • 12 metres for a lot that adjoins more than one road or laneway. 

Semi-detached development on all other R2 zoned land 

All other proposed semi-detached dwellings will be subject to the following controls: 

(c) minimum lot size of 325 square metres, 

(d) minimum frontage of:  

  • 7.5 metres for a lot that adjoins a single road, or
  • 6 metres for a lot that adjoins more than one road or laneway.
